Terms and Conditions

Background to Promotion

1. Mirvac Victoria Pty Ltd (Mirvac or the Promoter) recently introduced the Smiths Lane First Home Buyer Promotion (Promotion).

2. The Promotion will run for a limited time. The Promotion commences on Wednesday, 4th November 2026 and ends on the earlier of:

a. ends on the earlier of Friday, 18th December 2026 or when the first 10 Eligible Lots are sold under the Promotion

(Promotion Period).

3. Under the Promotion, subject to these terms and conditions, an Eligible Buyer (as defined in condition 8) who is a first home buyer will be entitled to obtain a $10,000 rebate on the purchase price (inclusive of GST) of an Eligible Lot (as listed at the end of these conditions), at settlement, provided that the contract for sale for the Eligible Lot is entered into during the Promotion Period and the Eligible Lot is one of the first ten (10) Eligible Lots for which an unconditional contract of sale is entered into under the Promotion. The Promotion is available to first home buyers only.

4. The amount of the rebate applicable to a relevant Eligible Lot is set out in the table at the end of these terms and conditions (Promotion Rebate).

5. The Promotion is limited to the first ten (10) Eligible Lots sold under the Promotion. An Eligible Lot is counted when Mirvac and the Eligible Buyer have both signed an unconditional Contract and any required deposit has been paid. Mirvac’s records are conclusive as to the order in which Contracts are entered into and the number of Eligible Lots sold. Once ten (10) Eligible Lots have been sold, the Promotion will close, even if the Promotion Period has not ended. Mirvac will publish notice that the Promotion is closed on the Smiths Lane by Mirvac website.

6. The Promotion Rebate is in addition to, and may be combined with, any other offer currently available from Mirvac for the Eligible Lot, including Mirvac’s Springtime Offer (which provides up to $35,000 rebate on selected lots). Each offer remains subject to its own eligibility criteria, availability and terms and conditions. Entitlement to the Promotion Rebate does not reduce, and is not reduced by, any rebate or benefit under any other Mirvac offer, and eligibility for other offers is not affected by the limit on the number of Eligible Lots under the Promotion.

7. The following terms and conditions apply to the Promotion. By participating in the Promotion, Eligible Buyers agree to be bound by these terms and conditions.

Promotion Terms and Conditions

The Eligible Buyer will only be entitled to take part in the Promotion if the following terms and conditions are satisfied:

8. The Promotion is for first home buyers who:

a. are natural persons over the age of 18 years and are not a company, registered builder, superannuation funds or persons acting as agent on behalf of other persons;

b. have not been referred to Mirvac or Smiths Lane by a referring channel agent;

c. are not an employee, agent, consultant or related entity of Mirvac;

d. enter into an unconditional contract of sale with Mirvac for the purchase of an Eligible Lot (Contract) during the Promotion Period and before the Promotion closes under condition 5.

e. pay the deposit required under the Contract on or before the date required by the Contract;

f. comply with the terms of the Contract and are not otherwise in default under the Contract; and

g. settle the acquisition of the Eligible Lot on the due date for settlement required under the Contract,

h. have not owned or had a relevant interest in a residential property in Australia before and have not previously received or retained a grant, exemption or concession under any scheme or policy for first home buyers from any State Government or the Federal Government;

i. provide a statutory declaration in a form satisfactory to Mirvac declaring the matters set out in paragraph 8h above.

9. Subject to complying with the terms and conditions of this Promotion and the relevant provisions set out in special conditions of the Contract, Mirvac will provide the Eligible Buyer with the Promotion Rebate.


10. The Promotion Rebate will be provided by way of an adjustment in favour of the Eligible Buyer at settlement of the Contract. Further Terms and Conditions of Promotion

The following additional terms and conditions also apply to the Promotion:

11. The Eligible Buyer acknowledges and agrees that the Promotion is non-transferrable, non-refundable and cannot be exchanged for cash. All taxes which may be payable as a consequence of receiving or participating in the Promotion are the sole responsibility of the Eligible Buyer.

12. The Eligible Buyer must disclose the contents of this Promotion to any lending institution providing finance to the Eligible Buyer to assist with the purchase of the Property.

13. The Eligible Buyer forfeits all rights to receiving or participating in the Promotion if the Eligible Buyer does not comply with any of these terms and conditions or any term or condition under the Contract. 14. Except as set out in condition 6, this Promotion cannot be used in conjunction with any other promotion or campaign provided by Mirvac.

15. The Eligible Buyer should obtain its own tax and legal advice in relation to the Promotion and Mirvac makes no representations and gives no warranties in this regard.

16. To the extent permitted by law, Mirvac is not liable to the Eligible Buyer for any direct, indirect, consequential, exemplary, incidental, special or punitive damages arising out of or in connection with the Eligible Buyer’s participation in this Promotion even if Mirvac has been advised of the possibility of such damages.

17. Prior to an Eligible Buyer’s entry into the Contract, Mirvac reserves the right, acting reasonably, to cancel, terminate, modify, extend or suspend the Promotion at any time, or to confirm that the Promotion has closed because ten (10) Eligible Lots have been sold, by notice published on the Smiths Lane by Mirvac website available here: https://smithslane.mirvac.com.

18. If there is any inconsistency between these terms and conditions and the provisions of the Contract entered into by a person participating in the Promotion, the Contract prevails.

19. These terms and conditions are governed by the laws of Victoria.

Privacy Collection Statement

20. The Mirvac Group (Mirvac Limited and its controlled entities) collects and uses personal information about you to promote its products and services and may disclose personal information to third parties agents and services providers. Mirvac also uses your personal information for related purposes including to request your feedback on the products and services provided by Mirvac. If you do not provide all the personal information Mirvac requests from you, Mirvac may be unable to provide these products or services to you.

21. Mirvac may disclose personal information about you to third party agents and service providers to assist Mirvac in the operation of its business to provide the products and services you request. Your personal information may also be disclosed to overseas recipients who use the personal information to assist Mirvac in the operation of its business in countries including, but not limited to, the United States of America, the Philippines, Japan and United Kingdom. 22. 23. By participating in the Promotion, you agree to Mirvac using your personal information to promote its products and services. If you no longer wish to receive promotional information from Mirvac, you may advise Mirvac of your wish.
