Terms and Conditions

Background to Promotion

1. Mirvac Victoria Pty Ltd (ABN 42 006 708 363) of Level 8, 1 Southbank Boulevard, Southbank VIC 3006 (Mirvac or the Promoter) recently introduced the $20,000.00 (including any GST) GlobeWest Furniture Voucher and $20,000.00 (including any GST) Deposit promotion exclusively for Townhomes built by Mirvac (limited to lots 472, 474, 485, 486, 487, 488, 489, 490) for sale at Smiths Lane by Mirvac, Clyde North (Promotion).

2. The Promotion will run for a limited time. The Promotion commences at 10:00am on Thursday 3rd October 2024 and ends at 5:00pm on Monday 2nd December 2024 or unless sold out prior (Promotion Period).

3. Under the Promotion, subject to these terms and conditions, Mirvac will offer a $20,000.00 (including any GST) furniture voucher that can be used to purchase GlobeWest furniture and/or accessories (GlobeWest Voucher) to Eligible Buyers who purchase a town home (limited to lots 472, 474, 485, 486, 487, 488, 489, 490 - subject to availability) listed on the pricelist for Stage 4A, The Tilion Release as at 3rd of October 2024 at Smiths Lane by Mirvac, Clyde North (Eligible Property) during the Promotion Period.

4. Subject to the terms and conditions of the Promotion, which are set out below and in the contract for sale and purchase, Mirvac will require a $20,000.00 (including any GST) deposit for Home Buyers who purchase an available Mirvac built Townhome at Smiths Lane by Mirvac during the Promotion Period.

5. The following terms and conditions apply to the Promotion. By participating in the Promotion, Eligible Buyers agree to be bound by these terms and conditions.

Promotion Terms and Conditions

The Eligible Buyer will only be entitled to take part in the Promotion and receive the GlobeWest Voucher if the following terms and conditions are satisfied:

6. The Promotion is for buyers who:

a) are natural persons over the age of 18 years acting on their own behalf. The Promotion is not open to companies, registered builders, superannuation funds or persons acting as agent on behalf of other persons;

b) have not been referred to Mirvac or Smiths Lane by a referring channel agent;

c) are not an employee, agent, consultant or related entity of Mirvac;

d) enter into an unconditional contract of sale with Mirvac for the purchase of an Eligible Property (Contract) during the Promotion Period;

e) pay the full $20,000.00 (including any GST) deposit required under the Contract on or before the date required by the Contract;

f) comply with the terms of the Contract (and any special conditions in relation to the GlobeWest Voucher) and not otherwise be in default under the Contract;

g) settle the acquisition of the Eligible Property (and not exercise the cooling-off period under the Contract) on the settlement date as required under the Contract (together Eligible Buyer)

7. Subject to complying with the terms and conditions of this Promotion and the provisions set out in the Additional Special Conditions of the Contract,
Mirvac will offer the Eligible Buyer the GlobeWest Voucher.

8. The GlobeWest Voucher will be provided to the Eligible Buyer by Mirvac within 30 days of settlement of the Eligible Property. Mirvac will offer the Eligible Buyer during the promotion period to pay $20,000.00 deposit to secure their Smiths Lane Townhome (GST inclusive) (Promotion Rebate).

Further Terms and Conditions of Promotion

(Eligible Buyer)

1. The Eligible Buyer acknowledges and agrees that the Promotion is non-transferrable, non-refundable and cannot be exchanged for cash. All taxes which may be payable as a consequence of receiving or participating in the Promotion are the sole responsibility of the Eligible Buyer.

2. The Eligible Buyer must disclose the contents of this Promotion to any lending institution providing finance to the Buyer to assist with the purchase of the Property.

3. The Eligible Buyer forfeits all rights to receiving or participating in the Promotion if the Eligible Buyer does not comply with any of these terms and conditions or any term or condition under the Contract.

4. This Promotion cannot be used in conjunction with any other promotion or campaign promoted by Mirvac.

5. The Voucher may be subject to further terms and conditions imposed by GlobeWest.

6. To the extent permitted by law, Mirvac is not liable to the Eligible Buyer for any indirect, consequential, exemplary, incidental, special or punitive damages arising out of or in connection with the Eligible Buyer’s participation in this Promotion.

7. Prior to an Eligible Buyer’s entry into the Contract, Mirvac may, acting reasonably, cancel, terminate, modify, extend or suspend the Promotion at any time by notice published on Smiths Lane by Mirvac website available here: https://smithslane.mirvac.com/

8. If there is any inconsistency between these terms and conditions and the provisions of the contract of sale entered into by a person participating in the Promotion, the contract of sale prevails.

9. These terms and conditions are governed by the laws of Victoria.

Privacy Collection Statement

1. The Mirvac Group (Mirvac Limited and its controlled entities) collects and uses personal information about you to promote its products and services and may disclose personal information
to third parties agents and services providers including GlobeWest. Mirvac also uses your personal information for related purposes including to request your feedback on the products and services
provided by Mirvac. If you do not provide all the personal information Mirvac requests from you, Mirvac may be unable to provide these products or services to you.

2. Mirvac may disclose personal information about you to third party agents and service providers to assist Mirvac in the operation of its business to provide the products and services you request.
Your personal information may also be disclosed to overseas recipients who use the personal information to assist Mirvac in the operation of its business in countries including, but not limited to,
the United States of America, the Philippines, Japan and United Kingdom.
